Judge denies former SAPD officer James Brennand's motion for change of venue

Meanwhile, a previous charge of attempted murder against Brennand was replaced with a count of deadly conduct.

SAN ANTONIO — Efforts by a former San Antonio Police Department (SAPD) officer accused of shooting Erik Cantu in 2022 to move the trial out of Bexar County have failed.

Wednesday, a judge denied a motion for a change of venue filed by James Brennand's attorneys.

Brennand's attorneys argued the move is warranted because of "inflammatory publicity" of the case. Brennand was arrested for shooting Cantu in the parking lot of a McDonald's as the teen tried to drive away. 

The entire case was refiled Feb. 27 to reflect changes to the charges Brennand is facing. He was previously facing two counts of aggravated assault by a public servant and one count of attempted murder; after re-indicting the case, the attempted murder charge was replaced with a count of deadly conduct.  

Brennand was fired within days of the Oct. 2, 2022, shooting, and indicted just two months later. Cantu was in the hospital for seven weeks after the incident.
