BEXAR COUNTY, Texas — On Nov. 27, 42-year-old Dan Fitts was sentenced to 20 years in prison on failure to stop and render aid - death charges.
According to the Bexar County District Attorney's Office, on June 10, 2020, Fitts was riding his motorcycle on Loop 410 at speeds exceeding 100 mph when he reportedly crashed into another man riding on a motorcycle. The victim lost control of his motorcycle and was seriously injured due to the crash.
Fitts was reportedly aware of the victim's injuries but still fled the scene without calling 911 or helping the injured man.
Later that day, officials said Fitts called the 911 non-emergency line to report the damages to his bike for insurance purposes. The next day, Fitts reportedly called again and claimed to be the victim of a hit-and-run that damaged his motorcycle.
The release states when Fitts was confronted by mutual friends, he justified his actions by expressing he wasn't "that stupid" to call 911, risking potentially being arrested for racing on the highway.
Fitts has a previous felony conviction for possession of a firearm by a felon along with a burglary with a deadly weapon, which classified him as a repeat offender.
Fitts was found guilty by a jury back on Oct. 2, but the sentencing was postponed for a pre-sentencing investigation, which the judge uses to assess a punishment.
“As a habitual offender, Dan Curtis Fitts will spend a lot of time in prison due to his incredibly irresponsible decisions.” said Bexar County Criminal District Attorney Joe Gonzales, “And, we hope others will learn a critical lesson from this case,”
