New charges filed in connection with fatal dog attack that killed 1-year-old boy

The dogs' fate will be decided next week.

SAN ANTONIO — The latest affidavit for an arrest warrant connected to a dog attack that killed a one-year-old baby goes into great detail about not only the boy's injuries, but the conditions inside the northeast Bexar County home where the violent ambush took place.

The document describes how investigators who entered the home described they found "living conditions deplorable."

The detective wrote "the residence had animal feces all over the floor, holes in the wall, dirty laundry and trash on the floor."

The narrative was used to file two additional charges against the owner of three dogs accused of attacking and killing Jiryiah Johnson Monday morning.

Heather Rodriguez was initially charged in connection to the injuries to the baby.

Now, two additional charges have been lodged against Rodriguez.  One count accuses her of causing reckless bodily injury to her own teenaged daughter by leaving her in the home with the dogs.  

The second count accuses Rodriguez of placing the baby in imminent danger by leaving him in the home without adequate supervision.  

The initial bond for Rodriguez was set at $100,000. The two new charges add $150,000 to secure her release from jail.

Investigators detailed the account given by the girl, who described how the attack began.   

She told detectives the baby was on her lap while she was sitting on a bed playing a video game.  The girl said the door was closed but dogs were able to gain access to the room because they had previously chewed through the bottom of the door. 

The teen said when the first dog attacked, she tried to save the baby, but the attack continued from room to room across the house until she was able to grab a phone, call for help and use her body as a blockade to keep the dogs behind a door.

Detectives say the girl declined an offer of hospital treatment, but she had visible injuries to her arms, hands, feet and legs, including bite marks and scratches.

The details of the boy's injuries outlined in the document are extensive and heart-wrenching, including that at the hospital "the (child) at one point had flat-lined, but was able to be revived." 

While the charges involving the children move forward in district court, there is a separate proceeding moving forward in Justice of the Peace, Precinct 4 regarding the disposition of the dogs that attacked the baby.

With regard to procedures, a Bexar County spokesman provided the following statement:

"As per Texas Health and Safety Code 822.02, in the case where a dog commits serious bodily injury or death, a dog may be seized with a warrant."

Upon the date of the seizure, the court must have a hearing within ten days to determine the disposition of the dog(s). 

Where death has occurred, if the court finds the dog did cause a death, the Court must order the dog(s) destroyed.

At this time, Bexar County Animal Control is in a holding pattern until a hearing has been held.

Court personnel say there will be a hearing next week to determine the fate of the animals but the date and time are not yet set.
