BEXAR COUNTY, Texas — On Thanksgiving Day, Nov. 24, 2022, Joanna Baker was shot multiple times in the head by her boyfriend, Paris Shaw. There was a witnesses to the shooting, and the next day Shaw was charged with aggravated assault with a deadly weapon.
Days later, Joanna Baker died from her injuries, but her brother is angry the charges were never upgraded.
"Putting it on her forehead, telling her you're going to kill her and pulling the trigger, that's first degree murder, to me it's capital murder," said Chris Arnett, Joanna's brother.
Chris Arnett said he is surprised at a recent plea deal given to Paris Shaw, in Joanna's death.
The shooting happened in the 10000 block of Barbwire Pass, near 1604 and Culebra. According to an arrest affidavit, a witness said Shaw was being loud and belligerent with Baker. He then left the room and came back with a rifle without the stock.
The affidavit says Shaw, then emptied out some bullets, put the gun between her eyes and threatened to pull the trigger. The witness then said Baker said, "go ahead, I don't care."
That's when Shaw shot her multiple times in the head.
Another witness in the home said she heard Shaw say, "I shot her. I shot her. I thought the clip was empty. I didn't mean to."
"I spent 10 1/2 years in the military, 3 tours in Iraq, anybody with common sense knows you don't point a gun at somebody, unless you intend to kill them," said Arnett.
Days later, Joanna died in the hospital from her injuries. Arnett said recently, the district attorney's office contacted his parents to tell them Shaw was being offered a plea deal.
Arnett said he would have liked the charges to be upgraded and the case go to trial.
KENS 5 reached out to the DA's office for comment. They said a plea was offered to Shaw, and he accepted the deal on Oct. 31.
Shaw is awaiting sentencing later this month. Shaw can be sentenced anywhere from 5 to 25 years.
"I think the DA could do so much better. It's almost as if you can shoot somebody, kill somebody, and get away with it in San Antonio. That's just not fair to you know Joanna's family. It's not fair to Joanne, and that he's pretty much going to walk after this," said Arnett.
The DA's office said they cannot discuss the reason why Shaw was given a plea deal until after the sentencing.
