Driver charged with first-degree murder after deadly northwest Austin crash that killed 16-year-old

Police say the suspect drove a stolen vehicle involved in the August crash on Hart Lane.

AUSTIN, Texas — A suspect has been arrested after a deadly crash earlier this year in northwest Austin.

According to the Austin Police Department (APD), Jeremy Josue Giron Hernandez was arrested on Oct. 8 for his involvement in a collision on Aug. 7.

Police said the crash happened just after 2:30 a.m. along the 6800 block of Hart Lane in West Austin. Four people were inside the vehicle during the incident, which did not involve any other cars.

According to an affidavit, Giron Hernandez was driving a stolen Hyundai and accelerated through an attempted traffic stop by an officer. The officer ceased pursuing him for safety reasons after he ran a red light at Hart Lane and Far West Boulevard.

About a minute later, police reported that a crash had occurred involving the Hyundai in the 6800 block of Hart Lane. Police returned to the scene and located 16-year-old Andrew Fonseca Reyes unconscious with an active video recording on his iPhone.

The video captured the stolen Hyundai losing control and hitting a rock on the west side of the road, before the three passengers got out and ran away from the scene. Two of the passengers returned to the scene briefly before fleeing again.

The driver and two passengers were able to safely leave the scene, but Fonseca Reyes was taken to a hospital and later died on Aug. 8.

Investigators were able to identify the two occupants, both of whom were juveniles, who had ridden with Giron Hernandez after their mothers reported the incident to Round Rock police.

One of the juveniles said that Giron Hernandez picked him and the other up before entering Austin, telling police that he encouraged Giron Hernandez to slow down despite him running from police. He then admitted to running from the scene after the crash occurred.

After reviewing the evidence, investigators determined that Giron Hernandez was the driver of the vehicle. An arrest warrant went out for Giron Hernandez on Oct. 1, and he was arrested earlier this month in Williamson County.

Giron Hernandez has been charged with first-degree murder in connection with the incident.

This was the city's 50th deadly car crash this year and the 53rd death.
