Father sues apartments claiming negligence for 6-year-old son's death in fire

Rudy Alejos filed a wrongful death lawsuit against the Summerview Apartments’ owners and managers claiming negligence. A fire at the apartment complex killed his 6-year-old son. The lawsuit claims the apartments violated several fire codes.

SANANTONIO - The father of a six-year-old boy killed in a massive apartment fire on the south side is suing.

Rudy Alejos filed a wrongful death lawsuit against the Summerview Apartments owners and managers claiming negligence.

The August 16th fire displayed more than a hundred residents and killed six-year-old Rudy Alejos Jr.

Alejos attorney Blake Diezmann said, We believe but for the negligence of the apartment and or the management company, his son would not have died.

The lawsuit claims the Summerview Apartments violated several fire codes.

Diezmann said the violations include, among others, not having enough fire extinguishers and failing to enforce the city's fire code of not allowing outdoor grills within ten feet of an apartment building.

There are several witnesses that have stated someone was barbequing right before the fire started, he said,

A spokesperson for the San Antonio Fire Department said its investigators still have not determined a cause in the fire and it could be weeks before they do.

KENS 5 spoke with a manger of the Summerview Apartment who referred all questions concerning the lawsuit to their attorney.

As of Friday evening, KENS 5 was still waiting to hear back from the apartment s lawyer.
