Judge denies temporary restraining order in First Baptist Church of Sutherland Springs demolition case

The temporary restraining order, which was keeping the church from being torn down, was denied in Monday’s hearing.

SAN ANTONIO — There’s been a years-long battle over demolishing the First Baptist Church of Sutherland Springs. The site where 26 people lost their lives back in 2017.

Judge Russell Wilson did not extend the temporary restraining order which was keeping the church from being torn down. But now, even with that order gone, Judge Wilson is still willing to hear the case.

Monday's hearing comes nearly seven years after 26 people were killed during a mass shooting at First Baptist Church. 

KENS 5 spoke with the chief deputy district clerk for Wilson County who filled us in. The case is being reset on request which means if anyone is wanting to bring the case back before the judge, they'll have to contact the court coordinator to get a date. 

In 2021, church members voted to tear down former First Baptist Church. Some survivors were not in favor of that and filed a temporary restraining order to block the demolition from happening.

An attorney on the case representing the survivors told KENS 5 it could be several weeks before the next hearing. The chief deputy district clerk said plans for demolition were not brought up in Monday’s hearing.
