Man arrested, accused of shooting and killing another man with a BB gun

San Antonio police officers at first believed the victim died from a drug overdose, but an autopsy revealed the victim's body told a different story.

SAN ANTONIO — A man is behind bars accused of killing a man at an apartment complex close to downtown.

Robert Green Jr., has been arrested in connection to the death of 43-year-old Richard Garcia.

The crime happened on August 22 when San Antonio police responded to a disturbance call at the Parkside Apartments off the 1000 block of N. Frio St.

According to an arrest affidavit, a witness called police, reporting a man, now identified as Garcia, was outside “yelling and screaming.”

As officers were in route, the person called again reporting the man was “slumped over.”

Police documents report that when officers arrived on scene, they believed Garcia was suffering from a drug overdose, and gave him a single dose of Narcan.

EMS crews arrived a short time later, but could not save Garcia. He died on the scene.

An autopsy later revealed that Garcia's death was not caused by a drug overdose.

The Bexar County Medical Examiner determined Garcia died after someone had shot him in the chest with a BB gun, according to the arrest affidavit.

Investigators were able to track down witnesses who outlined the disturbing details of what they said happened that fatal night.

According to the arrest warrant, Garcia had gone to an apartment where he got into a heated argument with Robert Green Jr. over a bicycle.

Witnesses told detectives that Green reportedly then shot Garcia with a “long pellet gun,” and then told one witness to “drag the victim further down the sidewalk…and give the victim a fentanyl pill,” detectives wrote in the arrest warrant.

It’s unclear if the fentanyl pill, allegedly given to Garcia, contributed to his death, but the Medical Examiner ruled Garcia’s death as a homicide.

Green was arrested and charged with Manslaughter, his bond set at $125,000.

Green is also facing a charge of Fraud, unrelated to the Manslaughter case, after SAPD detectives said stolen credit cards and identification cards were found in Green’s wallet last year.

According to an arrest warrant for that case, there are multiple victims.
