New lawsuit filed by victim's family in deadly dog attack

This federal lawsuit was filed by the family of Ramon Najera.

SAN ANTONIO — Hours ago, we learned of another lawsuit filed in connection to the deadly dog attack from last year.

This time it’s against the City of San Antonio and City Attorney Andy Segovia. It claims they knew the dogs involved were dangerous before Najera’s death.

This federal lawsuit was filed by the family of Ramon Najera.

Its 18 pages long and it details the horrific mauling of the 81-year-old Air Force veteran.

Juanita Najera – also known affectionately as ‘Janie’ went on the stand to describe the horrific scene she witnessed as her late husband protected her from the two pitbull terriers that took his life.

“Ramon was screaming and screaming," she said. "And he kept on saying, ‘Janie, I can’t take him off of me. I can’t take the dog off of me Janie. I can’t’. The dog kept on pulling on his wrist. And we were screaming, I was screaming. ‘Somebody please help us, somebody please help us.' Nobody would come out.”

It also alleges the city released the dogs to the community despite repeated warnings and a history of attacks. It claims this resulted in the severe injuries of the victim’s wife and his death, violating their right to due process. Those claims, echoed on the stand, as Najera said the dogs should’ve never been returned – claiming city authorities knew the dogs were dangerous prior to her late husband’s attack.

“I don’t want nobody to have to go through what I’ve gone through,” she said.

This is the latest lawsuit to come out of the deadly dog attack from last year.

The dog’s owners, Christian Moreno and Abilene Schneider were arrested and charged.

And they are currently in the punishment phase of their trial.

The city attorney’s office sent KENS 5 this statement about the suit:

"The responsibility for the actions of pets lies with the pets’ owners, and in this case the owners have been found criminally liable. The City has not yet been served with the suit. The City will investigate the claims and address them in the litigation if needed."
