SAN ANTONIO — Bexar County prosecutors will be seeking the death penalty against Stephen Clare, the man accused of killing his baby girl, shooting his ex-wife and stabbing his other daughter last year.
District Attorney Joe Gonzales filed the notice on behalf of the State of Texas on Thursday morning, when 51-year-old Clare returned to court.
Clare will be back in court for another status hearing, which will allow attorneys from both sides to discuss the status of the case, facilitate the exchange of information and negotiate regarding a possible resolution. The judge may also be involved in the meeting.
This comes nearly one year after the incident occurred back in April of 2023, when he stabbed both his daughters, leaving the youngest, 11-month-old Willow Clare, dead from her injuries. Clare also shot his ex-wife.
Clare was indicted by a grand jury last June. He was also charged with attacking and injuring the baby's mother and sister.
In the 437th District Court in October, the judge reset the start of his trial for 90 days – or Jan. 8 – to allow for more time for discovery, or evidence-gathering process, to be completed. The judge also said additional records were needed before the trial could officially get underway.
He is facing charges that include capital murder and aggravated assault with a deadly weapon. Clare has been behind bars since his arrest after a judge denied him bail.
Eight inmates are currently on death row for Bexar County crimes, including Otis McKane, who was convicted of shooting and killing San Antonio Police Department Officer Benjamin Marconi in 2016. Clare's trial is currently scheduled to begin March 4, but it could be pushed back.
