Know the laws on fireworks ahead of New Year's Eve celebrations

Fireworks are illegal in San Antonio, but can be used in unincorporated Bexar County if you follow these rules.

SAN ANTONIO — It's important to know the local laws before you start shooting off fireworks on New Year's Eve.

First of all, it's illegal to use fireworks inside the San Antonio city limits, but folks can fire off their own fireworks in unincorporated Bexar County, as long as you follow these rules. Unincorporated Bexar County consists of any part of Bexar County that is not within a city’s limit. Other smaller cities within Bexar County’s limits — like Leon Valley, Alamo Heights and Helotes — all have restrictions that are similar.

The term “fireworks” includes but is not limited to “firecrackers, roman candles, sparklers, torpedoes, bombs, skyrockets, buzz bombs, atomic wings, aerial flash salutes, and trail blazers," according to officials in Bexar County.

The Bexar County Fire Marshal's Office shared some important safety guidelines to prevent accidents and injuries. 

Here are a few tips for using fireworks safely:

  • Make sure you only purchase fireworks from properly licensed vendors. 
  • Only use fireworks outdoors, and make sure to have a clear, open area for lighting them. Keep a bucket of water or a hose nearby in case of any mishaps.
  • Never allow children to handle fireworks. An adult should be present to supervise and ensure safety.
  • Do not use fireworks while under the influence of alcohol or drugs.
  • If a firework does not light, do not try to relight it. Instead, move away and dispose of it safely by submerging it in water. You should do the same with all debris left over after the use of fireworks. Smoldering fireworks debris in a trashcan is often the cause of residential fires. 
  • Follow all local laws and regulations regarding the use of fireworks. In Bexar County, it is illegal to:
    • Use fireworks within 600 feet of a hospital, sanitarium, veterinary hospital, school, or church.
    • Use fireworks within 100 feet of a place where flammable liquids or flammable compressed gases are stored or dispensed.
    • Use fireworks within 100 feet of a place where fireworks are stored or sold.
    • Ignite or discharge fireworks in or throw fireworks at a motor vehicle.
    • Violations resulting in property damage of less than $200 are a Class C misdemeanor.

It's also a good idea to make sure that your furry friends are inside and have a place to shelter should they be afraid of fireworks. You can help make this a safe and less stressful night for them.

By following these simple guidelines, you can help ensure a safe and enjoyable celebration for everyone.

San Antonio’s ordinance banning fireworks says that violators can be fined up to $2,000.

It's also a Class C Misdemeanor if a violation results in property damage in an amount of less than $200 and doesn't result in bodily injury or death.

A new state law enacted in September also gives fire professionals and law enforcement the ability to charge a person with arson if they recklessly cause a fire that damages a structure or other property such as a motor vehicle. If a person is found guilty under this law, the penalty can include fines up to $10,000 and possible jail time.
