On May 21, 2014, and June 2, 2014, KENS 5 aired two I-Team reports entitled "Oilfield Greed." In those reports, KENS 5 relied on information provided by individuals interviewed by the station but did not have the opportunity to interview Jon Christian Amberson.
KENS 5 relied on those individuals being interviewed to provide factual and accurate information. We have determined, after further investigation, that what we have previously reported was incorrect and needs further clarification.
We have to now set the record straight. In those I-Team reports, we reported on local San Antonio attorney Amberson's handling of a case for Michael and Cassandra Harms. The Harmses alleged Amberson handled their case in an unprofessional and unethical manner and filed a grievance against Amberson with the State Bar of Texas.
We reported that the Harmses said "Amberson has never shown them the contents of a settlement, and that they never signed it." Amberson disputes this and has given KENS 5 many documents that call into question the Harmses' statements.
The truth is that the settlement agreement was mediated in an all-day mediation and acknowledged and signed by the Harmses. In fact, the Harmses signed a Special Warranty Deed transferring their property back to Regency Oil.
No disciplinary action was ever taken against Mr. Amberson, and even though the Harmses did file a grievance against Mr. Amberson, those grievances were dismissed by the State Bar.
After further investigation and information that has come to light, the statements we reported about Mr. Amberson's potential improper handling of the Harmses' case have not proved to be true.
We apologize to Mr. Amberson for the inaccurate and incomplete presentation the I-Team reports presented about him.
