'Simply not enough evidence': Bexar County DA dismisses charges against Josh Primo

Now with the Clippers, the NBA guard has continued to maintain that his actions weren't intentional.

SAN ANTONIO — The Bexar County district attorney's office announced it has dismissed allegations of sexual misconduct against former Spurs guard Josh Primo, effectively ending a saga that started with the former top draft pick's unexpected exit from San Antonio. 

Primo, now with the Los Angeles Clippers, was accused of exposing himself on multiple occasions to Dr. Hillary Cauthen, a former consulting psychologist for the team. She later filed a lawsuit against the Spurs, claiming the organization did nothing after she reported the behavior, which allegedly happened during private therapy sessions. 

That lawsuit was dropped in November 2022, shortly after Cauthen and her lawyer held a news conference discussing the allegations. Spurs CEO RC Buford had said the team "disagreed with the accuracy of the facts, details and timelines presented."

On Thursday, the DA's office said evidence against Primo wasn't sufficient enough to pursue charges. 

"More than one prosecutor reviewed the evidence on each charge in this case," Bexar County DA Joe Gonzales is quoted as saying in a release. "Each determined that there was simply not enough evidence to prove the required elements of the charge and meet a prosecutor's statutory obligation."

After conducting its own investigation, the NBA suspended Primo for four games without pay earlier this year. Reports that he signed a two-way contract with the Clippers emerged just hours later. 

He has continued to maintain that his conduct wasn't intentional.
