Man arrested in fatal hit-and-run where father saved son from being hit, BCSO says

Jonathan Acosta was arrested and charged with collision involving death, a second-degree felony.

SAN ANTONIO — A man is in custody after allegedly fatally hitting a man with his truck in early June on the far west side of the city. 

Jonathan Acosta turned himself in Thursday and faces charges of collision involving death, a second-degree felony punishable by up to 20 years in prison. 

According to an arrest affidavit, 55-year-old Raul Pena was walking with his 12-year-old son on June 3 when he was struck by a driver in an unknown vehicle who didn't stop. The accident occurred on the Dove Canyon access road at Loop 1604. 

Authorities said Pena moved his son out of the way to avoid being hit by the truck. Emergency crews performed life saving measures on Pena and he was transported to a local hospital, but later died. 

At the time of the accident, deputies believed it was a dark Toyota Tacoma or Tundra that struck Pena. Authorities collected evidence from the scene including debris from the truck's grill, including the letters T and O believed to indicate the vehicle's manufacturer.  

Investigators were able to obtain video surveillance showing the suspect's vehicle before and after the accident, records say. They continued their investigation and found Acosta owned a gray Toyota Tacoma that was consistent with evidence found at the scene of the crash. 

Witnesses also stated Acosta had been drinking the night of the accident. 

According to the arrest affidavit, Acosta told investigators, "I want to give my side of the story because I was involved in an accident. There were two males crossing the access road from 1604 going towards the shoulder. I did not see them." 

Acosta was booked into the Bexar County jail and has since been released on bond.
