SAN ANTONIO — A woman who was shot by a Northside ISD officer last October has filed a lawsuit against the district and the two officers involved in the incident.
On Oct. 28, 2023, Markay Garcia was attempting to attend a high school football game her husband was coaching in before being stopped by NISD officers Kyle Kennedy and Joseph Garcia in the Farris Athletic Complex parking lot.
The lawsuit alleges that after being stopped, the officers "immediately resorted to the use of deadly force," adding, "the unwarranted stop of her vehicle ended with Officer Kennedy shooting [Garcia] through the driver's side, open window."
Back when the incident took place, Northside ISD spokesman Barry Perez said that Garcia was acting aggressive while in her vehicle in the stadium parking lot and her behavior drew the attention of an NISD officer who was at the scene directing traffic prior to a football game at the stadium.
Perez said Garcia then began to drive towards the officer in a threatening manner, prompting him to draw his weapon and fire one round.
Kennedy was placed on administrative duty following the incident pending the investigation.
The lawsuit also claims that NISD and its policymakers, specifically Superintendent Dr. John M. Craft and board members, enabled this situation when they hired Kennedy "in spite of numerous red flags from his prior job with the Live Oak Police Department."
Following the shooting, Garcia was hospitalized. The lawsuit states that she received severe and permanent injuries to her arm.
